Official Rules

Rules:
It is the contestant’s responsibility to copyright all original entries submitted. Sygnpay cannot be held liable for any copyright infringement. Only one entry per contest can be submitted. Songs submitted by contestants that has been written or produced by anyone other than the contestant submitting that song must be submitted with a notarized authorization and permission of use form accompanied by the contestants video submission. Syngpay cannot be held liable for the use of an unauthorized entry that has been entered by a contestant without an notarized authorization and permission of use form accompanied with the contestants submission. The ramifications of unauthorized or copyright infringed audio and/or video entries will solely fall on the contestants entering such submission.


All contestants will be required to sign a release and affidavit of eligibility when registering. This contest is void where prohibited by law. This contest provides the opportunity to be seen and heard by a mass audience, to win a cash prize of $10,000, and the opportunity to work with published  producers and writers and possibly be seen and inquired about by a major record label in which case inquiries offers and contracts will be negotiated by syngpay according to the terms and condition that governs The Platinum Artist Challenge.

 

How To Enter:
There is no entry fee required. In order to enter you must complete and submit your online registration at http://www.sysngpay.com. Once your online registration is processed you will receive a verification email and your video submitted for entry will be uploaded however, there is a $20.00 (twenty dollar) registration fee required for processing each entry.  Each contestant can only submit one song per challenge. All entries must be submitted on or before the end date and can only be submitted in the form of video via http://www.sysngpay.com. Contestants can also register to compete in separate contest held by http://www.sysngpay.com. All registration fees are nonrefundable and all submissions are final.

Judging:
Contestants will be judge based on:Lyrics (lyrics do not have to be written by the contestant), vocal arrangement, vocal performance, visual performance and originality. The contest will be narrowed down to 4 winners by fan votes via video likes. The top four (4) finalist will then face a panel of judges who will choose one winner.


Video entries must be of the contestant/contestants singing. We do not accept audio only entries.
Note: it helps your chances of getting more votes/likes if you video is longer than 30 seconds, so voters and judges can better evaluate your performance

 

Eligibility:

You must be a U.S. citizen.


You cannot be an established artist or song writer, meaning you cannot have had a record deal with or be presently signed to a major label or have had any major exposure to the masses supported, advertised, or promoted by any major Entertainment entity in the last 5 years. You cannot have had a song/songs in the top 30 of any chart of any genre in the last 10 years. Your songs can not be written or arranged by any writer who has had a song on any top 50 chart in the last 5 years. 


If a contestant has a legal and binding contract with any entertainment entity, submissions must be entered by a representative of that entity. Geographical, Age and Parental Consent Requirements:  Unless otherwise specified, each Contest is open to legal residents of the United States of America who are at least 18 years of age or older at time of entry or of legal age in accordance with the law in the state in which you legally reside. If a Participant has not reached the age of majority in the jurisdiction in which the Participant resides, they must obtain permission from their parent or legal guardian prior to entering a Contest.
 

Video Rules:
Bands, duets, and solo artists are allowed to compete. (Instruments are allowed to be used)  audio filter and software post recording may be used  (ex. autotune, echo, reverb), The upload format supported is MOV, MPG, AVI, FLV, F4V, MP4, M4V, ASF, WMV, VOB, MOD, 3GP, MKV, DIVX and XVID. Video must be in English. No nudity, sexual behavior, profanity, or absence content. Entrants must submit one video per contest that is no more than 3 minutes and 30 seconds in length. There are to be no logos or advertisement of any kind in the video this includes the background or on the clothing of contestant or anyone in the video unless it is directly associated with SyngPay and the platinum artist challenge. Logos or advertisements of any kind should be blurred out before video is submitted. We reserve the rights to remove a video deemed such. Video can be professionally edited video. We urge you to enter your video with the best audio and video quality possible, poor audio quality can affect your chances of winning if listeners, voters and judges can't hear or see your submission clearly. Syngpay will be using Youtube as a video platform only. Syngpay and The Platinum Artist Challenge is in no way associated with, affiliated with or endorsed by Youtube. You must comply with our Official Rules and Terms Of Use; as well as Youtube's Community Guidelines and Terms of Service.
 
Voting:
Registered syngpay user can vote for their favorite videos/artist at www. syngpay.com and share the video they like on Social media to help increase votes for your favorite video/artist. The video with the most amount of youtube likes will be posted on syngpay.com at the end of every month.


All registered and verified video will be on our SyngPay Youtube channel for viewing but all votes will have to be cast at syngpay.com. Each registered user may only have one vote per contestant. There is a link on syngpay.com that will take voters to our syngpay youtube channel.

 

Rules For Voting:

One user can vote on as many videos as desired however there is only one vote per video. You must be a registered SingPay user to vote. Contestants can vote once on their own video.The contestants with the most votes at the end of every quarter (4 months) will get a personal visit and interview from sygnpay staff and that video interview will be posted on our youtube channel and syngpay.com for thousands to view.
 

Any individual who enters, attempts to enter or in any way participates or attempts to participate in any contest, sweepstakes or giveaway (“Contest”) held by Syngpay, LLC d/b/a THE PLATINUM ARTIST CHALLENGE, (“syngpay.com”) (each such individual is hereinafter referred to as a “Participant”) agrees to be bound by the terms and conditions provided in these Official General Contest Rules (“General Rules”), as well as by Syngpay,s interpretations of these General Rules which are final and binding in all matters relating to any Contest.  Some Contests will have specific rules developed for them (“Specific Contest Rules”).  In the event there is a discrepancy or inconsistency between these General Rules and the Specific Contest Rules, the Specific Contest Rules shall control.

 

NO PURCHASE NECESSARY: 
Unless otherwise noted, no purchase is necessary to enter or win a prize. A purchase will also not improve your chances of winning.

 

APPLICABLE LAW (VOID WHERE PROHIBITED): 
All Contests are subject to and governed by applicable federal, state and local laws and regulations.  Participation in this Contest is void where prohibited or otherwise restricted by law. 

 

CONTEST CANCELLATION, SUSPENSION OR MODIFICATION:
Syngpay reserves the right to cancel, terminate, modify or suspend any Contest if the Contest is not capable of being completed as planned for any reason, including, but not limited to, infection by computer virus, “bugs,” tampering, unauthorized intervention, fraud, or technical failures of any kind or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of any such Contest.  The decision of Syngpay to cancel, terminate, modify or suspend any Contest shall be final in all respects. 


CONTEST DESCRIPTIONS:
All Syngpay Contests will be described through electronic, print or on-air advertising or promotion and governed by these General Rules unless the Contest has Specific Contest Rules developed for it.

 

Contest Entity and Immediate Family Member Disqualification:  
The officers, directors, employees, contractors, and agents of syngpay.com, Syngpay LLC DBA THE PLATINUM ARTIST CHALLENGE, Syngpay.com Operating Company and any entity involved in the sponsorship, development, production, implementation and distribution of any Contest as well as their respective parents, affiliates, divisions, subsidiaries and successor companies (the “Contest Entities”), and their immediate family members (and those living in the same household, whether or not related), are prohibited from participating in any Contest and do not qualify as Participants.

 

“Immediate family members” shall include spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws”, or by current or past marriage, remarriage, adoption, co-habitation or other familial extension. 

 

Past Prize Winners:  
Participants may only win a Contest once every ten (10) years.

 
Employer Restrictions:

Participant is solely responsible for reviewing and understanding Participant's employer's policies regarding Participant's eligibility to participate in contests.  Participant may be disqualified from entering into this Contest or receiving prizes if Participant is participating in this Contest in violation of his or her employer's policies. 

 

PARTICIPATION PROBLEM DISCLAIMER: 
Even if alleged to be caused by the sole or partial negligence of syngpay.com or other Contest Entity, syngpay.com and the other Contest Entities are not responsible for any problems which affect, or result from, Participation or attempted Participation in the Contest.  This includes, but is not limited to, the following problems:
    1    1.    Incorrect, incomplete or inaccurate entry information;
 
    1    2.    Human errors; 
 
    1    3.    Failures, omissions, interruptions, deletions or defects of any wireless network, telephone network, internet service, computer systems, servers, utility providers, or software; 
 
    1    4.    Inability to send a text-message; 
 
    1    5.    Identity theft; 
 
    1    6.    Tampering, destruction or unauthorized access to, or alteration of, entries or computer data; 
 
    1    7.    Network hackers or other unauthorized access to syngpay.com’ computer network;
 
    1    8.    Data that is processed late or incorrectly or is incomplete or lost due to wireless network, telephone network, computer or electronic malfunction or traffic congestion on wireless or telephone networks;
 
    1    9.    Printing errors; 
 
    1    10.    Equipment malfunctions; and
 
    1    11.    Late, misdirected, lost, misplaced, illegible, mutilated or not received entries.

 

RELEASE OF LIABILITY AND INDEMNIFICATION: 
As consideration for entering a Contest, all Participants agree to RELEASE, DISCHARGE AND COVENANT NOT TO SUE syngpay.com, Syngpay LLC, the other Contest syngpay.com (as described above) and each of their respective direct and indirect affiliates, divisions, parent and subsidiary companies, officers, employees, disc-jockeys, on-air personalities, shareholders, representatives, managers, members, directors, owners, agents, insurers, attorneys, predecessors, successors, and assigns thereof (collectively, the Released Parties), from and against all claims, damages, charges, injuries, losses, proceedings, suits, actions (including but not limited to tort actions, product liability actions, wrongful death actions, warranty actions, breach of contract actions, privacy and defamation actions, misappropriation of likeness actions, identity theft, loss of consortium claims), expenses and attorney fees that they or anyone on their behalf (including but not limited to their heirs, representatives or next of kin) have or might have for any death, injury, damage or claimed injury or damage arising out of, involving or relating to their participation in the Contest, including, but not limited to, any claim that the act or omission complained of was caused in whole or in part by the strict liability or negligence in any form of the Released Parties. 


Additionally, as consideration for entering the Contest, all Participants agree to INDEMNIFY, HOLD HARMLESS, AND DEFEND the Released Parties in any action or proceeding from and against all claims, damages, charges, injuries, losses, proceedings, suits, actions (including but not limited to tort actions, product liability actions, wrongful death actions, warranty actions, breach of contract actions, privacy and defamation actions, misappropriation of likeness actions, identity theft, loss of consortium claims), expenses and attorney fees that they or anyone on their behalf (including but not limited to their heirs, representatives or next of kin) have or might have for any death, injury, damage or claimed injury or damage arising out of, involving or relating to their participation in the Contest or for their failure to comply with the terms of the above release provision.  This agreement to indemnify, hold harmless and defend applies even if the act or omission complained of was allegedly caused in whole or in part by the strict liability or negligence in any form of the Released Parties.

 

CAUTION: 
ANY ATTEMPT BY ANY PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF ANY CONTEST, TELEPHONE SYSTEMS OR WEB SITE, OR UNDERMINE THE LEGITIMATE OPERATION OF ANY CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SYNGPAY.COM RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.  

 

Taxes: 
The Participant prize-winner is solely responsible for determining and paying all federal, state and local taxes (including any sales taxes).  Any person winning over $600 in prizes from syngpay.com during any one year period will receive an IRS Form 1099 at the end of the calendar year, and a copy of such form will be filed with the IRS.

 

syngpay.com reserves the right to substitute a cash prize of greater value if sponsors should join and add to the original amount.

 

HOW TO CLAIM PRIZE: 
Claiming the Prize: The Participant prize-winner must pick up their prize at a studio location designated by syngpay.com where the award will be video taped and  presented to participant by a syngpay.com representative and interviewed by syngpay.com personal for the purpose of but not limited to broadcasting, streaming via the internet, radio, television and any other media via cell phones etc. A press conference will be scheduled at the designated studio where the award/prize money will be given to contest winner. By accepting the award/prize money you irrevocably grant to syngpay.com the right to use all footage, your name and likeness, caricature, photograph, video, biography, clips, and all literature and all materials reasonably related to the syngpay.com PLATINUM ARTIST CHALLENGE for the purpose of promoting and advancing the syngpay.com PLATINUM ARTIST CHALLENGE.

 

Prerequisites to Prize Award:  
Prior to being awarded a prize, winners are required to provide (1) a valid government-issued photo identification depicting proof of age and (2) a valid taxpayer identification number or social security number. The social security number will be used for tax-reporting purposes. syngpay.com reserves the right to deny awarding the prize if the winner fails to provide satisfactory identification, as determined in syngpay.com’ sole discretion. 


Winners, and, to the extent the winner is a minor then their parent(s) or legal guardian(s) as well, may be required to execute an Affidavit of Eligibility/Release of Liability, a completed IRS W-9 and a Publicity Release before any prize is awarded.  By entering a Contest, Participant agrees to execute these documents if selected as a winner in order to receive their prize.  If the prize is travel tickets involving travel partners, the travel partners will be required to meet minimum age eligibility requirements and to execute an Affidavit of Eligibility/Release of Liability prior to receiving the companion travel ticket.  Except where prohibited by law, failure to execute any of these documents or comply with any of these terms will result in forfeiture of the prize.  


Prize Forfeiture:  
Unless otherwise stated, winners shall have thirty (90) days from the date of selection to claim and pick up their prize.  Failure to claim and pick up prize within this time for any reason will result in forfeiture of the prize.  syngpay.com reserves the right, in its sole discretion, to award unclaimed prizes after 90 days to the first runner up contestant whereas all rules and regulations herein above and below apply to winner. 

 

Additional Costs:
Any costs relating to the prizes are the sole responsibility of the winner.

 

Publicity Release: 
Unless prohibited by applicable law, Participant authorizes and irrevocably grants to syngpay.com and the other Released Parties (as defined above) permission to, from time to time, reference and discuss Participant and their participation in the Contest on-air and/or on their website(s) in photographs, video recordings, digital images, audio recordings, as well as in publications, newsletters, news releases, other printed materials, and in materials made available on the Internet or in other media now known or hereafter developed for any purpose syngpay.com and/or the Released Parties deem proper.  Such reference and discussion may involve Participant's name and voice, and other personal/biographical material or their participation on-air.

 

DISQUALIFICATION: 
All participants agree to be bound by these General Rules. Non-compliance with any of these General Rules will result in disqualification and all privileges as a Participant will be immediately terminated. syngpay.com, in its sole discretion, further reserves the right to disqualify any person for:  (i) tampering with the entry process or the operation of the Contest; (ii) gaining an unfair advantage in participating in the Contest; (iii) obtaining winner status using false, fraudulent or deceptive means; or (iv) engaging in otherwise unsportsmanlike, disruptive, annoying, harassing, or threatening behavior.

 

Paperwork: 
If you advance in the competition you will be required by the producer to fill out, sign and agree to all of the terms and conditions of additional forms, including a talent management contract, recording contract, music publishing contract, sing pay.com live tour agreement, online content agreement, Merchandising endorsement contract. You and your parents and or legal guardians in the case of contestants under 18 years of age may also be subject to a thorough background investigation and other examinations at producers discretion. If you're under 18 years of age, both you and your parent or legal guardian must sign into the forms and cooperate and having the forms court approved, if and when requested by producer. If you are under 18 years of age and you are a company to the audition by the Guardians appointed by your parent or legal guardian, you must have the release signed and notarized by your parent or legal guardian with authority to sign on your behalf and bring the signed and notarized released with you to the auditions.

 

ALL FORMS MUST BE FILLED OUT COMPLETELY AND TRUTHFULLY. IF YOU FAIL TO COMPLETE ANY FORM, GIVE ANY FALSE INFORMATION, OR FAIL TO REVEAL ANY PERTINENT INFORMATION, YOU MAY BE DISQUALIFIED FROM THE COMPETITION.

 

GOVERNING LAW AND JURISDICTION:
This Contest shall be governed by and construed in accordance with the laws of the State of New York, without reference to its conflict of laws principles. By entering the Contest, Participants hereby submit to the jurisdiction and venue of the federal and state courts of New York and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum. In no event, will any Participant be entitled to injunctive relief or equitable relief of any kind, or restrain the continuation of any Contest.
